Terms of service
Terms of Service
1. About these terms
This website is operated by Story of a Stone, operated under the ABN; 17 374 707 084. Throughout these Terms of Service, the words “we”, “us” and “our” refer to Story of a Stone.
These terms apply when you visit stonestory.life, purchase a product, book a service or event, access digital material or otherwise use the website.
By using the website or placing an order, you agree to these terms and the policies linked through the website. If you do not agree, you should not use the website or purchase through it.
2. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy available under the Competition and Consumer Act 2010, including the Australian Consumer Law, or any other right that cannot lawfully be excluded, restricted or modified.
3. Eligibility and lawful use
You must be legally capable of entering into a purchase agreement in your place of residence or have the permission of a parent or legal guardian.
You must not use the website or our products for an unlawful purpose, interfere with the website's operation, introduce malicious code, attempt to obtain unauthorised access or infringe the rights of another person.
4. Products and descriptions
We take reasonable care to describe and photograph our products accurately.
Many products are handmade, naturally grown, aged, plant dyed or created in small batches. Natural variations in colour, texture, shape, aroma, leaf size, glaze, carving or finish are part of their individual character and are not necessarily faults.
Screen settings and lighting can affect how colours appear. These natural and visual variations do not limit your rights when a product is faulty, unsafe or substantially different from its description.
Product availability, harvest information and stock quantities may change without notice.
5. Tea, incense and wellbeing information
Information about tea, herbs, incense, meditation, traditional practices or wellbeing is provided for general educational and cultural purposes.
It is not medical advice and should not replace advice from a qualified health professional. If you are pregnant, breastfeeding, taking medication, living with a medical condition or sensitive to caffeine, smoke, fragrance or another ingredient, seek suitable professional advice before use.
You are responsible for using products according to any supplied instructions and in a manner suitable for your circumstances.
6. Prices and payment
Prices are shown in the currency selected on the website. Unless stated otherwise, Australian prices include applicable taxes.
Shipping charges, international duties and any other applicable charges are shown or described before the order is completed where reasonably possible.
Payment must be authorised through one of the methods available at checkout. We do not directly store full payment card details.
7. Orders
An order confirmation means that we have received your order. It does not necessarily mean that the order has been accepted or dispatched.
We may contact you to verify information or resolve a stock, pricing, delivery or payment issue. We may refuse or cancel an order where reasonably necessary, including when a product is unavailable, a price is clearly incorrect, payment is not authorised or we reasonably suspect fraud or unlawful activity.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled portion.
8. Shipping and delivery
Shipping is governed by our Shipping Policy, which forms part of these terms.
Delivery timeframes are estimates unless we expressly agree to a guaranteed service. We are not responsible for delay caused by an event outside our reasonable control, but we will continue to meet any obligations and provide any remedies required by law.
9. Returns and refunds
Returns, exchanges and refunds are governed by our Return and Refund Policy, which forms part of these terms.
Our published change of mind conditions do not limit any right or remedy available under the Australian Consumer Law.
10. Events, courses and digital content
Additional conditions may apply to tea sits, workshops, courses, events, recordings or other digital content. Where additional conditions apply, they will be presented with the offering and form part of the purchase agreement.
You must not reproduce, distribute, resell, publish or commercially exploit digital content or course material without our written permission.
11. Intellectual property
Unless otherwise stated, the website and its text, photographs, illustrations, product names, designs, course materials, recordings and other original content belong to Story of a Stone or are used with permission.
You may view the website and make purchases for personal use. You must not reproduce, publish, sell, modify or commercially use our content without written permission, except where permitted by law.
12. Third party services and links
The website may use or link to services operated by Shopify, payment providers, delivery providers, social media platforms and other third parties.
Third party services may have their own terms and privacy practices. We are not responsible for content on an external website that we do not control. This does not limit our responsibility for services we choose to use to fulfil your order where the law makes us responsible.
13. Website availability and information
We try to keep the website available and accurate, but we do not guarantee that access will always be uninterrupted or that every minor error will be corrected immediately.
We may update products, prices, content and these terms from time to time. Changes apply from the date they are published and do not remove rights that have already arisen under an earlier purchase.
14. Liability
To the maximum extent permitted by law, Story of a Stone is not liable for indirect or consequential loss arising from use of the website or products when that loss was not reasonably foreseeable.
Nothing in this section limits liability or responsibility that cannot lawfully be limited, including liability under applicable consumer law.
15. Privacy
We handle personal information in accordance with our Privacy Policy and applicable law. By using the website, you acknowledge that information may be processed by service providers involved in payments, website hosting, order fulfilment, communication and delivery.
16. Governing law
These terms are governed by the laws of South Australia and the applicable laws of Australia. You and Story of a Stone submit to the courts and tribunals that have jurisdiction in South Australia, without limiting any right a consumer may have to bring a claim in another jurisdiction.
17. Severability
If part of these terms is found to be invalid or unenforceable, the remaining terms continue to apply to the extent permitted by law.
